1. Acceptance of Terms
By accessing and using PlatePhoto ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service") provided by PlatePhoto.
2. Description of Service
PlatePhoto is an AI-powered food photography generation service that allows users to create, generate, and manage food photography images using artificial intelligence technology. The Service includes:
- AI-powered image generation based on user-provided prompts and parameters
- Image storage and management through user accounts
- Template gallery and exploration features
- Credit-based usage system for image generation
- Subscription plans and payment processing
3. Use License
Permission is granted to temporarily use PlatePhoto for personal and commercial purposes, subject to the following restrictions:
- You may not modify or copy the materials, except for images you generate through the Service
- You may not use the Service for any illegal or unauthorized purpose
- You may not attempt to reverse engineer, decompile, or disassemble any part of the Service
- You may not use automated systems or bots to access the Service without explicit permission
- You may not share, resell, or redistribute your account credentials
This license shall automatically terminate if you violate any of these restrictions and may be terminated by PlatePhoto at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
4. User Account
To access certain features of the Service, you must register for an account. When you create an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate, current, and complete
- Maintain the security of your account credentials, including your password
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Ensure that you are at least 18 years old or have parental consent if under 18
You are responsible for maintaining the confidentiality of your account and password. PlatePhoto cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
5. Prohibited Uses
You may not use our Service for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You agree not to:
- Use the Service to generate, create, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
- Generate images that infringe upon the intellectual property rights of others
- Use the Service to create content that violates any applicable laws or regulations
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks
- Use any automated system, including "robots," "spiders," or "offline readers," to access the Service
- Collect or harvest any personally identifiable information from the Service
- Use the Service for any commercial purpose without appropriate authorization or in violation of these Terms
6. Content and Intellectual Property
User-Generated Content: Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, images, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
Ownership of Generated Images: Subject to your compliance with these Terms, you own the images you generate through the Service. However, you grant PlatePhoto a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such images for the purpose of operating and improving the Service.
Service Intellectual Property: The Service and its original content, features, and functionality are and will remain the exclusive property of PlatePhoto and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Third-Party Content: The Service may contain content provided by third parties, including templates and sample images. Such content is the property of its respective owners and is protected by applicable intellectual property laws.
7. Subscriptions, Payment Terms, and Credits
7.1 Subscription Plans
PlatePhoto offers various subscription plans with different features, credit allocations, and pricing. Subscription plans are billed on a monthly or annual basis, as selected during purchase. Each subscription plan includes a specific number of credits that can be used to generate images.
Subscription plans may include features such as ultra-realistic image generation, watermark removal, private visibility, reference image uploads, poster generation, commercial licensing, and priority support. The specific features included in each plan are detailed at the time of purchase.
7.2 Billing and Auto-Renewal
Billing Cycle: Subscription fees are billed in advance on a recurring basis according to your selected billing cycle (monthly or annual). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
Auto-Renewal: By purchasing a subscription, you authorize PlatePhoto to automatically charge your payment method on file at the beginning of each billing cycle. You will be charged the then-current subscription fee for your plan. We will notify you of any price changes in advance as described in Section 7.6.
Payment Methods: We accept payment through credit cards, debit cards, and other payment methods as made available through our payment processor (Stripe). You agree to provide current, accurate, and complete payment information and to promptly update your payment information if it changes.
7.3 Credits System
The Service operates on a credit-based system. Credits are consumed when you generate images. The number of credits required depends on the number of variations requested and the quality level selected.
Credit Allocation: Credits are allocated to your account upon successful payment of your subscription fee. Credits are added to your account balance at the beginning of each billing cycle for subscription plans.
Credit Expiration: Credits allocated through subscription plans do not expire during your active subscription period. However, if your subscription is cancelled or expires, any unused credits may expire according to our credit expiration policy, which will be communicated to you at the time of cancellation.
Credit Rollover: Unused credits from your current billing period may roll over to the next billing period, subject to any limits or restrictions that may apply to your subscription plan. We reserve the right to modify credit rollover policies at any time with reasonable notice.
7.4 Subscription Cancellation
How to Cancel: You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation requests must be submitted before the next billing cycle to avoid being charged for the upcoming period.
Effective Date: Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service and all subscription benefits until the end of your paid period. No partial refunds will be provided for the unused portion of your current billing period, except as required by law or as described in Section 7.5.
Post-Cancellation: After cancellation, your account will revert to a free tier (if available) or be restricted according to our account policies. You will lose access to subscription-only features upon expiration of your paid period.
7.5 Refunds and Returns
General Policy: All subscription fees are non-refundable except as required by applicable law or as expressly stated in these Terms. We do not provide refunds for partial billing periods, unused credits, or subscription fees already paid.
Refund Eligibility: Refunds may be provided at our sole discretion in exceptional circumstances, such as:
- Technical issues that prevent you from using the Service for an extended period
- Billing errors or unauthorized charges
- As required by applicable consumer protection laws in your jurisdiction
- Within a specified refund period (if any) that may be offered for new subscriptions
Refund Requests: To request a refund, please contact our support team with your account information and a detailed explanation of your request. Refund requests must be submitted within a reasonable time after the charge, and we reserve the right to deny refund requests that we determine, in our sole discretion, do not meet our refund criteria.
7.6 Price Changes
We reserve the right to modify our subscription pricing at any time. If we increase the price of your subscription plan, we will provide you with at least thirty (30) days' advance notice via email or through a notice in the Service.
Price Change Notice: Price changes will not affect your current billing period but will apply to subsequent billing cycles. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.
Grandfathered Pricing: We may, at our discretion, maintain your current pricing for existing subscribers, but we are not obligated to do so. Any such grandfathering will be communicated to you at the time of the price change.
7.7 Subscription Modifications
Upgrades: You may upgrade your subscription plan at any time. When you upgrade, you will be charged a prorated amount for the difference between your current plan and the upgraded plan for the remainder of your current billing period. The upgrade will take effect immediately, and your next billing cycle will reflect the full price of the upgraded plan.
Downgrades: You may downgrade your subscription plan, but downgrades will take effect at the beginning of your next billing cycle. You will continue to have access to your current plan's features until the end of your current billing period. No refunds or credits will be provided for the unused portion of your current plan when downgrading.
Plan Changes: We reserve the right to modify, suspend, or discontinue any subscription plan at any time. If we discontinue your plan, we will provide you with reasonable notice and offer you an alternative plan or a prorated refund for the unused portion of your subscription.
7.8 Failed Payments and Account Suspension
Payment Failure: If your payment method fails or is declined, we will attempt to charge your payment method again. If payment continues to fail, we may suspend or cancel your subscription and restrict access to the Service.
Account Suspension: If your subscription payment fails, we will notify you and may suspend your account until payment is successfully processed. During suspension, you may lose access to subscription features and your account may be restricted.
Reactivation: To reactivate your subscription after a payment failure, you must update your payment information and successfully process the payment. We are not responsible for any loss of data or access to features during the suspension period.
7.9 Billing Disputes
If you believe you have been charged incorrectly, you must contact us within sixty (60) days of the charge date. We will investigate your claim and, if we determine that an error occurred, we will issue a credit or refund as appropriate.
If you dispute a charge with your payment provider (e.g., credit card company) without first contacting us, we may suspend or terminate your account. You agree to cooperate with us in resolving any billing disputes and to provide any information we reasonably request.
7.10 Taxes
You are responsible for paying all applicable taxes, duties, and government charges that may be imposed on your subscription or use of the Service. Prices displayed on our website are exclusive of applicable taxes unless otherwise stated. We may collect taxes as required by law, and you agree to pay any additional amounts that may be required.
7.11 One-Time Purchases
In addition to subscriptions, we may offer one-time credit purchases. One-time purchases are non-refundable except as required by law or at our sole discretion. Credits purchased through one-time purchases may be subject to different expiration terms than subscription credits.
One-time purchases do not include subscription features and are separate from subscription plans. You may combine one-time purchased credits with subscription credits in your account balance.
8. Privacy
Your use of PlatePhoto is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices. By using the Service, you consent to the collection and use of information in accordance with our Privacy Policy.
9. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Disclaimer
The information on PlatePhoto is provided on an "as is" basis. To the fullest extent permitted by law, PlatePhoto:
- Makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights
- Does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site
- Does not guarantee that the Service will be uninterrupted, secure, or error-free
- Does not guarantee that the AI-generated images will meet your specific requirements or expectations
11. Limitation of Liability
In no event shall PlatePhoto or its suppliers, partners, or affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on PlatePhoto, even if PlatePhoto or a PlatePhoto authorized representative has been notified orally or in writing of the possibility of such damage.
Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Our total liability to you for all claims arising from or related to the use of the Service shall not exceed the amount you paid to PlatePhoto in the twelve (12) months prior to the action giving rise to liability.
12. Indemnification
You agree to defend, indemnify, and hold harmless PlatePhoto and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) your violation of any term of these Terms; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Content caused damage to a third party.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
14. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You irrevocably submit to the exclusive jurisdiction of the courts in the United States. If you are located outside the United States, you agree to comply with all local laws regarding online conduct and acceptable content.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
